Dear User,

FAIR BNB NETWORK Soc. Coop. released the platform refugees.fairbnb.coop to facilitate the interaction between accommodation owners (hosts) and refugees, people in need, seeking a shelter. The service is led in collaboration with NGOs, humanitarian organizations that empower the process and perform safety checks of the hosts' supply.

The platform allows visitors and hosts to register, by creating a personal account on fairbnb.coop and enables access to the listings.

Fair BnB Network is the data controller of the process which is performed pursuant to Article 13 of EU Regulation 2016/679.

 What personal data is processed?  

Fair Bnb Network collects the following categories of personal data:

  • Registration data: whether you are a visitor or a host, you can register your account through the dedicated form by inserting identification data (such as first and last name, date of birth, country of residence and contact data such as email address);

  • Photos/descriptions of accommodations/profile photos of hosts for submission of accommodation proposals (listings) to refugees;

  • Navigation data, required to enable communications between the platform and your device. This category of data includes IP addresses or domain names of the computers used by users connecting to the site, addresses in URI (Uniform Resource Identifier) notation of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the user's operating system and computer environment. Data is used for the sole purpose of obtaining anonymous statistical information about the use of the website and to check its correct operation and is deleted immediately after processing. The data could be used to verify liabilities in case of data breach or computer crimes.

Why and on what legal basis do we process data?  

Fairbnb processes your data for the following purposes:

  • to enable you, through browsing and registering your own account on the platform, in facilitating the match between people seeking accommodations and hosts;

  • to communicate hosts' and refugees' data to Fair Bnb's partners (NGO humanitarian organizations);

  • to ensure legal and regulatory compliance;

  • to process anonymous statistics;

 

Processing is lawful due to:  

  • the performance of a contract to which the data subject is a party or the performance of pre-contractual measures taken at the request of the data subject (Art. 6(1)(b) GDPR);

  • comply with a legal obligation to which the data controller is subject (Art. 6(1)(c) of the GDPR);

  • pursuit of the legitimate interest of the data controller (art. 6, par.1, lett. f of the GDPR) in connection with the organization of activities, communication to third parties and/or recipients for activities related and necessary to the relationship;

The provision of data for pre-contractual and contractual purposes is necessary and failure to provide it will make it impossible for the user to access the service.

Where do we store and process your data?

Personal data will be processed within the European Union.

In any case, it is understood that the Data Controller will have the right to transfer such data abroad to countries outside the European Union, should it become necessary.

In this case, the Data Controller assures from now that the transfer of data outside the EU will take place according to the applicable legal provisions.

Specifically, data will be transferred abroad to non-European countries only if the level of data protection in the Third Country has been deemed adequate by the European Commission under Article 45 of the GDPR or after adoption of adequate safeguards under Article 46 of the GDPR (binding corporate rules, standard contractual clauses, code of conduct, certification mechanism).

In the absence of an adequacy decision, the data transfer may be carried out if there is one of the exceptions provided for in Article 49 of the GDPR (e.g., explicit consent, transfer necessary to perform contractual or pre-contractual measures, important reasons of public interest, establishment, exercise or defence of legal claims, etc).

How long do we keep your data?  

Account registration data will be kept until you request for account cancellation.

 Who will process your data?  

Data will be processed by collaborators and companies that carry out activities to promote and support our services, acting as data processors, such as:

  • the team of the platform;

  • Local node contacts for organizational purposes with their hosts;

  • Technology partners dedicated to the proper operation of the platform and data storage.

In carrying out its activities and in pursuit of the above purposes, the owner may disclose your data to:

  • public administrations, control bodies, public security authorities, judicial authorities and other subjects, entities or authorities acting in their capacity as autonomous data controllers, to whom it is mandatory to communicate the data by virtue of legal provisions or orders of the authorities;

  • ONGs and institutional entities in order to facilitate the matching of supply and demand.

Some information, such as name, accommodation photo, possible profile photo, and personal description of hosts, is made public and made available to anyone who browses the platform and is looking for available accommodation. Such data, therefore, is disseminated on the platform and may be made available to unspecified parties.

No data of the user searching for accommodation is subject to dissemination.

Your rights as data subject  

As a data subject, you have the right to ask the data controller for access to data, rectification, deletion of data, restriction of processing, as well as the right to portability or to object to the processing of data under the conditions set out in Articles 15,16,17,18,20,21 of EU Regulation 2016/679.

Finally, the data subject has the right to lodge a complaint with a Supervisory Authority if he or she believes that the processing concerning him or her violates the EU Regulation.
