CONSUMER INFORMATION ACCORDING TO DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

 

Dear User,
Fair Bnb Network Società Cooperativa, with its registered offices in Bologna, Via Casarini, 19, VAT: IT03735181202 is the sole owner of the web platform refugees.fairbnb.coop.

The aim of the platform is to allow charitable hosts and people seeking shelter to connect and the platform, together with its NGOs' partners, will help the connection and interaction.

While Fair Bnb Network Società Cooperativa actually maintains the technological infrastructure, the actual moderation, checking of shelter opportunities, monitoring of the contacts and most of the backend activities are performed by local organizations or public institutions, already partner of the cooperative, that will assist shelter seekers and charitable hosts in their journey. The list of these partners is available in the contact area of the website.

This is still a beta version of the final platform, but it offers already:

to all visitors, the possibility to browse the website and use the search engine to look for possible shelters in communities where refugees.fairbnb.coop is already active and managed by a local humanitarian organization or public institutions.
In order to contact shelters' offerers, visitors need to register and only then will they be able to message the potential host via the internal messaging system.
to hosts, the possibility to insert shelter opportunities, flats/apartments/houses, shared rooms, independent rooms to be matched with the needs of shelter seeking organizations and individuals. At the moment, it is not possible/allowed to request or accept payments through the platform, in case some form of compensation or contribution to the expenses is required please make it clear in the description of the listing and make sure to make it clear during the contact phase.

You may cancel your registration at any time by sending an email to shelter@fairbnb.coop and also you may consider our privacy policy statement for data processing issues.

This document is also quoted in the below legal text as “terms”. These Terms represent a basic agreement between the User and Fair Bnb Network società cooperativa (shown below also as Fairbnb.coop), as refugees.fairbnb.coop platform owner.
The above premises are relevant to understand, to form, to interpret and to execute the agreement and the obligations set by these Terms.


SECTION 1 – BASIC ACCOUNT

1. Registration to refugees.fairbnb.coop website – User Profile

By registering through the form on the website, the User inserts the identification as an individual or an organisation, name, surname, country of residence and email address in order to be identified and to access his/her own account on refugees.fairbnb.coop.

The registration implies the provision of true information about user identity and a valid email address for the communications required.

The User represents and warrants that all information provided is current, complete and accurate and declares to have the legal capacity to be part of this agreement.

The registration allows the user to create the User Profile aimed at collecting basic information, photo and user’s description.
Information provided will be in any case managed according to the Privacy Statement and the following versions of these Terms.

2. Identification

The access to the platform and the use of services require certain identification of users.
The user must remember that any agreement deriving from the contact happened on our platform is entirely and solely in charge of the parties involved and Fairbnb Network Soc. Coop. is not included as an involved part.
Refugees.fairbnb.coop is entitled to request specific documents or to ask for a further check of each User’s personal identity and, in case of uncertainty, may terminate or not permit the registration to the platform at its complete discretion.

3. The search engine

The platform provides users with a search engine aimed at showing the list of available shelters, based on the seeker needs and search filters.
Such a list is intended only to facilitate interaction between seeker and offerer and does not imply any discrimination or pre-selection of locations that are identified solely based on territorial criteria. This tool, therefore, does not in any way constitute a form of pre-contractual collaboration with the user, but only a tool for accessing all available shelter opportunities, in any case without prejudice to the possible formation of a hospitality agreement between the parties: this is confirmed by the fact that the access to the search engine is open to all navigators, even if not registered on Fairbnb.coop. No booking option is actually present in refugee.fairbnb.coop's platform.

4. Shelter offering Platform Services

Once the shelter page is displayed, the potential guest may click on the “contact me” button to seek contact with the host, according to the terms provided in the description of the shelter and these terms of use.
The platform facilitates the communication between the parties using point & click system and alerts the users of new messages via transactional emails and in platform alerts.
In case the shelter seeker and the host reach an agreement, they are the only parties responsible for said agreement, formed using the platform communication service and therefore are the only responsible for compliance with the applicable laws in each country.
Fair BnB Network Soc. Coop suggests both seekers and offerers to seek support from local public offices and humanitarian organizations to support them in the hospitality process and the required paperworks.

5. Become a host

By selecting the option “register” basic users are allowed to insert shelter opportunities in the platform to be accessed through the platform search engine.
This implies accepting the terms and conditions provided in this section.

6. Listings & Lawfulness

Shelter offerers users are enabled to publish, after the platform's formal check, through the refugees.fairbnb.coop platform, hospitality proposals to host shelter seekers in their properties: these proposals are also called “listings” in these Contractual Terms.
Host users may create listings only if they are legally entitled to host in their property according to the applicable law.

By accepting these Terms, host users confirm the fulfilment of such a requirement.

The information inserted in the listing form should be real and non-deceptive and it is strictly forbidden to insert photos showing people, kids or items that could in any way represent a violation of discretion and/or privacy data protection laws.

Copyright licensing rule is applied to the contents provided by the Host user according to article 12.

7. Listings Management

Host users could manage their listings and messages from the specific page in their user account.
The Host users, by accepting these Terms, agree to submit to refugees.fairbnb.coop listings that are actually available and to complete the availability calendar with precise as possible information.

8. Hospitality Agreements

Refugees.fairbnb.coop, in any case, advises users to draw up and sign a proper and lawful hospitality agreement in order to prove and/or fulfil the legal obligations provided by each user Country.

 
SECTION 2 – MISCELLANEA


9. refugees.fairbnb.coop messaging system / web-chat

Shelter seekers Users are entitled to use the web-chat tool available in the private area of the platform, to contact Hosts. Such a contact is intended only to let users exchange information about the listings and possible agreements to be formed between the parties.
The web-chat is supervised by Fairbnb.coop staff to prevent infringements on our policies.
The web-chat shows only the user’s profile photo and username. Users are the sole liable for information, data, personal data and contents shared in the web-chat.
The current version of the platform does not consider users to be registered for business purposes, so additional personal data shared in the web-chat is not covered by the data processing law.

10. Liability

The refugees.fairbnb.coop platform offers only services to facilitate the meeting of users.
From the above, it follows that in no way does refugees.fairbnb.coop intervene in potential agreements and contractual relationship between the parties nor does it offer guarantees regarding the promises contained in the listings or in the users’ profile information.

Fairbnb Network Soc. Coop. is not responsible for fake listings or any other incorrect information that will be spread with this initiative, even though Fairbnb strongly condemns them.
Fairbnb.coop is therefore not liable in any way for damage or other negative effects that may result to users resulting from the contact they entertained using the platform refugees.fairbnb.coop.

11. Termination of User Account

Fairbnb.coop may terminate or suspend User Account at any time in the event of any conduct by the User that refugees.fairbnb.coop, in its own discretion, may consider being in conflict with the project principles or in the event of any violation by the User of these Terms.

12. Copyright and Intellectual Property

All texts, graphics, photographs, trademarks, logos, icons, sounds, music, videos, artwork, software and computer code present on the platform are owned by or licensed to Fairbnb.coop. Such content is protected by copyright and trademark laws, trade and unfair competition laws.

The listings media-content is intended licensed to Fairbnb.coop: uploading of this content implies the acceptance of Creative Commons Attribution-NonCommercial 4.0 International Public License as you may find at this link

13. Governing Law and Jurisdiction

According to l. 218/1995 and Reg. (CE) n. 593/2008, User Account and/or use of the platform also in this demo phase, shall be governed by and interpreted exclusively in accordance with the laws and decisions of the State of Italy, without giving effect to its conflict of laws provisions. Consumers’ rights are protected according to the same provisions. Civil lawsuit proceedings should be brought in Italy’s Court. 14. Consumers’ Rights

By accepting these terms the users declare to be aware of the consumer information set below and specifically confirm that no right of withdrawal is available for the services provided (according to European Directive 2011/83/EU)

15. Changes to Terms

Any change to these Terms will be labelled as a new version of this document and asked for new consent at the time of logging of the User to the platform. Also, an email will be sent to advise about the updates.

a) Refugees Fairbnb.coop is a platform that offers useful services to facilitate the meeting of users interested in concluding hospitality agreements for people in seek of shelter.
b) The Refugees Fairbnb.coop platform and the services offered by it are owned by Fair Bnb Network Società Cooperativa, with its registered offices in Bologna, Via Casarini, 19, VAT: IT03735181202

f) No cost is charged to the users for registration on the platform.
i) The duration of this contract is for an indefinite period, but the user has the freedom to withdraw by using the option to cancel an account at any time or by sending a request to the address refugee@fairbnb.coop.
